Subclass 461 Visa Australia: A Complete Guide for Partners of New Zealand Citizens

The Subclass 461 visa allows family members of New Zealand citizens who hold (or will hold) a Subclass 444 visa to live in Australia temporarily.

With this visa, you can:

• Live in Australia

• Work full-time

• Study

• Travel in and out of Australia freely

The visa is granted for five years and can be applied for either onshore or offshore.

There are several pathways under the 461 visa, but the most common one is as a partner of a New Zealand citizen on a Subclass 444 visa.

You may be eligible if:

• Your partner is already in Australia on a Subclass 444 visa, or

• You are travelling to Australia together and your partner will be granted a 444 visa on arrival

Evidence that your relationship is recognised publicly:

• Photos together

• Travel history

• Statements from friends and family

4. Commitment to Each Other

Personal statements outlining:

• Your history together

• How you support each other

• Your future plans

If you’re married, include your marriage certificate.
If de facto, provide evidence that your relationship meets the legal definition.

The goal is to show your relationship is real, stable and ongoing.

This is where the Subclass 461 visa becomes unique.

In some circumstances, you may still be eligible even after separation.

If You Are in Australia

You may still qualify if:

• You currently hold a 461 visa, or

• Your last substantive visa was a 461

• Your relationship has ended

• You have not become the family member of someone else

In certain cases, you can continue on the 461 pathway as an independent applicant.

You may still be eligible if:

• The last visa you held in Australia was a 461

• Your relationship has ended

• You have not become the family member of another person

And you meet one of the following:

• You lived in Australia on a 461 visa for at least 2 out of the last 5 years, or

• You have strong business, employment, cultural or personal ties that benefit Australia

You must also not have been outside Australia for 5 years or more, unless there are compelling reasons.

This flexibility is one of the reasons the 461 visa is so valuable.

Unlike most partner-based visas, the Subclass 461 offers options even if a relationship ends. However, the rules are strict and highly technical.
